Welcome to SplatTools, operated by SAI KIRAN NUNEMUNTHALA ("we", "us", or "our"). By accessing or using our services, you agree to be bound by these Terms of Service. Please read them carefully before using our platform.

1. Acceptance of Terms

By creating an account or using SplatTools services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our services.

2. Description of Service

SplatTools provides image preprocessing tools designed for 3D Gaussian Splatting and photorealistic 3D reconstruction. Our services include:

Video frame extraction with AI-powered sharpness detection
Mask generation for image preprocessing
HDR video support with 10-bit color processing
Additional preprocessing tools for photogrammetry workflows

3. Account Registration

To access certain features of SplatTools, you must create an account. You agree to:

Provide accurate, current, and complete information during registration
Maintain and update your account information as necessary
Keep your login credentials secure and confidential
Accept responsibility for all activities that occur under your account
Notify us immediately of any unauthorized use of your account

4. Token-Based Billing

4.1 Usage Model

SplatTools operates on a usage-based billing model using tokens. Charges accrue automatically as you use our services, with no minimum commitment required.

4.2 Token Pricing

Input tokens: $0.60 per million tokens
Output tokens: $5.00 per million tokens

For reference, a 4K image (2160 × 3840) typically consumes approximately 735 input tokens, with output varying based on the prompt complexity.

4.3 Token Validity

Prepaid tokens remain valid for 12 months from the date of purchase.

4.4 Auto-Reload

If you enable auto-reload, tokens will be automatically replenished when your balance falls below the specified threshold. You may disable this feature at any time in your account settings.

4.5 Payment Processing

All payments are processed by Paddle.com, our authorized reseller and Merchant of Record. By making a purchase, you also agree to Paddle's terms of service. Paddle handles all payment processing, invoicing, and sales tax compliance on our behalf.

5. User Content and Ownership

5.1 Your Content

You retain full ownership of all videos, images, and other content you upload to SplatTools. We do not claim any intellectual property rights over your content.

5.2 License to Process

By uploading content, you grant SplatTools a limited, non-exclusive license to process your content solely for the purpose of providing our services. This license terminates when you delete your content or close your account.

5.3 Privacy Commitment

We operate with a privacy-first approach. We never use your uploaded content to train our AI models or share it with third parties for purposes other than providing our services to you.

6. Acceptable Use

You agree not to use SplatTools to:

Violate any applicable laws or regulations
Infringe upon the intellectual property rights of others
Upload content that is illegal, harmful, threatening, abusive, or otherwise objectionable
Attempt to gain unauthorized access to our systems or other users' accounts
Interfere with or disrupt the integrity or performance of our services
Engage in any activity that could damage, disable, or impair our infrastructure
Use our services to generate content for illegal purposes

7. Intellectual Property

SplatTools and its original content (excluding user content), features, and functionality are owned by SAI KIRAN NUNEMUNTHALA and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

8. Limitation of Liability

To the maximum extent permitted by applicable law, SplatTools shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or related to your use of our services.

Our total liability for any claims arising from your use of the service shall not exceed the amount you have paid us in the twelve (12) months preceding the claim.

9. Disclaimers

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that our services will be uninterrupted, secure, or error-free, or that any defects will be corrected.

10. Termination

We may terminate or suspend your account and access to our services immediately, without prior notice or liability, for any reason, including if you breach these Terms of Service.

Upon termination, your right to use the service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.

Your continued use of our services after any changes to the Terms constitutes your acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Portugal, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of Portugal.
